The petitioner seeks bail in connection with Gorea Kothi P.S. Case No. 164 of 2016 dated 21.12.2016 instituted for the offence under Section 414 of the Indian Penal Code. The petitioner was found to be in possession of a stolen motorcycle.

Learned counsel for the petitioner has however submitted that because of his criminal antecedents, he has unnecessarily been roped in this case with false allegation. In fact, nothing was recovered from his possession. The petitioner is in custody since 22.12.2016. It has also been submitted that in the other cases in which the petitioner has been made accused in past, he is on bail.

Patna High Court Cr.Misc. No.48442 of 2017 (4) dt.29-11-2017 Taking into account the aforesaid facts, this Court is inclined to grant bail to him.

The petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateXIII, Siwan in connection with Gorea Kothi P.S. Case No. 164 of 2016.
