ANJANA MISHRA ORAL ORDER 18-11-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor on behalf of the State. The petitioners are in custody since 24.08.2019, in connection with Guthani P.S. Case No. 138 of 2019 for the offenses under Sections 30 (a), 38(i), 41(i) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioners submits that the alleged recovery was not made from the conscious possession of the petitioners. The petitioners are merely driver and cleaner of the vehicle in question.

Considering the aforementioned facts and circumstances and that the petitioners have no criminal

No.67885 of 2019(2) dt.18-11-2019 2/2 antecedent, let the petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II, Siwan, in connection with Guthani P.S. Case No. 138 of 2019.
