In the night of 25.05.2017, victim Raushan aged about 15 years slipped from her house. During course of search, it has been alleged that petitioner Uday Singh got the informant talked with her daughter and further, disclosed that she will return. She also came to know that Rahul Sharma with the aid of petitioner Uday Singh, Chandan Kumar, Batal Singh, Ram Subhag Singh, Dhiraj took her away. It has also been disclosed that Rahul had taken away Raushan on 18.05.2017 and a day thereafter she returned back. From para-31 of the case diary, it is evident that the victim refused to be medically examined and so, the conclusive evidence with regard to her age remained absent. During course of her statement under Section 164 CrPC, it is evident that she came out
Patna High Court Cr.Misc. No.43630 of 2017 (3) dt.09-11-2017 from her house on the alleged date on a call made by Rahul where, she found the aforesaid Rahul along with others including the petitioner and then thereafter, she was taken away by one Amit after pressing her mouth. Then thereafter, she was taken to Ara where she was confined for eight days and then thereafter, she was released.
In the aforesaid facts and circumstances of the case, petitioner, Uday Singh @ Uday Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ACJM, Danapur in connection with Rani Talab PS Case No. 91/2017.
