The petitioner apprehends his arrest in connection with Manjhagadh P.S. Case No. 168 of 2019, registered under Sections 120(B)/190 of the Indian Penal Code and Sections 25(1-b)(a)/26/35 of the Arms Act.

The accusation is that on receiving secret information about gathering of Notorious criminals with sophisticated weapons at the house of petitioner for committing heinous crime, the informant along with other police personnel reached at village Bhaisahi near the house of the petitioner then on seeing the police party, one person started to flee away but on chase, he was caught hold, who disclosed his name as Atul Kumar Singh. On search, one country made loaded pistol and five live cartridges of .315 bore recovered from his

Patna High Court CR. MISC. No.64160 of 2019(2) dt.22-10-2019 2/2 possession. On search of house of petitioner, 24 cartridges of .315 bore and 116 cartridges of 22 bore recovered from the room situated in Varandah of the house.

Learned counsel for the petitioner submits that, in fact, petitioner has filed Complaint Case No. 400 of 2016 in the court of Chief Judicial Magistrate, Gopalganj against the police personnel due to highhandness due to that reason, petitioner has falsely been implicated in this case, showing the recovery of 24 cartridges of .315 bore and 116 cartridges of 22 bore from the room situated in Varandah of the house of the petitioner. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Gopalganj, in connection with Manjhagadh P.S.
