1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Ahiyapur P.S. Case No. 795 of 2020 dated 07.10.2020 registered for the offence(s) punishable under Section(s) 498A and 302 read with 34 of the Indian Penal Code.
3. This is second attempt of the petitioner for the relief of regular bail after his earlier attempt for the said relief was rejected by this court vide order dated 30.08.2022 passed in Cr. Misc. No. 7633 of 2022 preferred by this petitioner.
4. The main submissions advanced by learned counsel for the petitioner are that the petitioner earlier preferred criminal miscellaneous for the relief of regular bail which was rejected by this court with granting a liberty to the petitioner to
Patna High Court CR. MISC. No.78677 of 2023(3) dt.08-12-2023 2/3 renew his bail prayer after one year from the date of the said order, if the trial of the petitioner is not concluded within the said period of one year hence in the light of said liberty he has come again before this court for relief of regular bail as till date not a single witness of the prosecution has been examined despite 19 adjournments having been given to the prosecution by the trial court. Further submissions are that the petitioner has been languishing in jail since 09.08.2021 and the marriage of the petitioner with the deceased who is said to be victim, took place more than 12 years ago and during investigation, all the material witnesses stated that the victim died due to suicide as she had no good relation with her husband and her in-laws.
5. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
6. Considering the above submissions and mainly taking into account the prosecution's lingering attitude in producing the prosecution witnesses in the trial of the petitioner as stated above and also taking into account the petitioner's custody period as well as the stage of his trial, this court is now inclined to accept the bail prayer of the petitioner. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the
