2. The petitioner has preferred this application for grant of regular bail in connection with Akorhigola P.S. Case No. 149 of 2022 dated 20.10.2022 registered for the offences punishable u/s 395 of the Indian Penal Code.
3. As per the prosecution case, 8 unknown miscreants confined the workers of the informant and took away three tractors with Dalla, stone paper of iron about 120 pieces, 4 Gas cylinders and other materials from the construction site.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of
Patna High Court CR. MISC. No.73537 of 2024(2) dt.18-10-2024 2/3 the petitioner has surfaced in this case during the course of investigation. No T.I.P. has been conducted by the prosecution. No incriminating article has been recovered from the conscious possession of the petitioner. The charge-sheet has already been submitted against the petitioner. There is general and omnibus allegation against the petitioner. The co-accused person has already been granted regular bail by this court vide order dated 11.05.2023 passed in Cr. Misc. No. 16826 of 2023. The petitioner is accused in thirteen other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 10.01.2024.
5. Learned A.P.P. for the State has vehemently opposed the prayer of bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Rohtas at Sasaram in connection with Akorhigola P.S. Case No. 149 of 2022 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date,
Patna High Court CR. MISC. No.73537 of 2024(2) dt.18-10-2024 3/3 failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
