The petitioner seeks bail in connection with a case registered for the offence punishable u/s 30(a)(b)(c)(d)33/34/36 of Bihar Prohibition and Excise (Amendment), 2016. 3.

Altogether, 19.5 litres of foreign liquor is said to have been recovered from the spot.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has been implicated in this case due to ulterior motive. No such occurrence, in the manner as alleged has taken place and the whole allegation is concocted. It is further submitted that petitioner was not apprehended from the spot nor any incriminating article has been recovered from his conscious physical possession. The recovery of the alleged

Learned APP for the State opposed the prayer for bail.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court, Barh (Patna), in connection with Barh P.S. Case No.203 of 2024.
