ANJANA MISHRA ORAL ORDER 09-04-2018 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioners apprehend their arrest in connection with Mushahri P.S. Case No. 99 of 2017 for the office registered under Sections 147, 149, 323, 324, 307, 504 and 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner no.3, namely, Arun Kumar has been arrested during the pendency of the application as such, the application against him has become infructuous.
The application against petitioner no.3, namely,
Patna High Court Cr.Misc. No.16399 of 2018 (2) dt.09-04-2018 Arun Kumar is dismissed as infructuous.
So far as other petitioners are concerned, the main allegation is against one Santosh Thakur and not against these petitioners.
In view of the aforementioned facts and circumstances of the case and that the injuries have not been attributed to these petitioners and also found to be simple in nature, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., cum-Sub-Judge 3rd Muzuffarpur in connection with Mushahari P.S. Case No. 99 of 2017, subject to the condition as laid under Section 438(2) Cr.P.C.
