JUSTICE SUDHIR SINGH ORAL ORDER 05-03-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the opposite party No.2. The petitioner is apprehending his arrest in a case registered unders Section 498A, 341, 323, 504 of the Indian Penal Code.

Allegation against the petitioner is of committing torture upon the victim due to non-fulfilment of demand of dowry. A joint affidavit has been filed on behalf of the petitioner and the opposite party No.2. Following statements have been made in paras 2, 3, 4 and 5 of the joint affidavit. "2. That both the parties settled that they will reside in village Laga Moin, P.S. Rajnagar, Distt. Madhubani.

3. That husband will care and maintain properly and she will also provide proper co-operation.

4. That in any dispute bail and disposal will be subject to jurisdiction of learned court below.

5. That both the parties will obey terms and conditions."

Considering the submissions made on behalf of the parties, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri P.K. Mehtha, J.M. 1st class, Madhubani in connection with C.R. case No.421 of 2017, T.R. No.2700 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
