The petitioner is languishing in custody since 01.05.2017 in a case for the offence registered under Sections 341, 323, 307, 302, 504/34 of the IPC and 27 of the Arms Act. The prosecution story, in brief, is that the petitioner and others fired upon the cousin brother-in-law of the informant as a result of which he died.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. The charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present

Patna High Court Cr.Misc. No.42796 of 2017 (2) dt.20-09-2017 2/2 case due to mistake of fact. There is general and omnibus allegation has been made against the petitioner. No specific injury has been attributed against the petitioner.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Ist, Munger in connection with Naya Ram Nagar P.S. Case No. 79/2017.
