I do not see any cogent ground to issue notice against the O.P. Second Party and that being so, instant petition is dismissed.

However, petitioner will be at liberty to move before the learned lower court, in case, the situation so warrant. The learned lower court, if prayed, will pass appropriate order in accordance with law.
