JUSTICE SANJAY KUMAR ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned A.P.P. appearing on behalf of the State.

The petitioner seeks regular bail in connection with Jamalpur P.S. Case No. 109 of 2016 registered for the offences punishable under Sections 120-B, 326, 307 of the Indian Penal Code and Section 3 /4 of the Explosive Substance Act and later on Section 387 of the Indian Penal Code has also been added. It has been submitted that the petitioner is neither named in the F.I.R. nor any incriminating material has been recovered from his possession. The case has been registered against two named accused. In course of investigation, one Sumit Kumar was apprehended by police, who divulged the name of this petitioner. The said Sumit Kumar has been allowed bail by the

Patna High Court Cr.Misc. No.43958 of 2017 (2) dt.21-09-2017 lower court as it appears from the impugned order. The petitioner is in custody since 17.05.2017, having two more cases in which he is on bail.

The learned APP for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the learned A.C.J.M.-II, Munger in connection with Jamalpur P.S.
