JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2023 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Shekhpura Sarai P.S. Case No. 158 of 2022 registered for the offences punishable under Sections 406,419, 420, 467, 468, 471, 120B/34of the Indian Penal Code .

As per the prosecution case, informant got secret information that 20 to 25 unknown miscreants assembled for committing cyber crime and cheat innocent people. Seven accused persons were caught and others were fled away and various mobiles, ATM cards of different banks have been recovered from the place of occurrence which is alleged to be

It is submitted by the learned counsel for the petitioners that petitioners are named in the FIR on the basis of confessional statement of co-accused persons. Neither petitioners were apprehended on the spot nor any incriminating article has been recovered from person or possession. Petitioners have clean antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in Shekhpura Sarai P.S. Case No. 158 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C.
