2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 137(2), 140(1), 61(2) and 3(5) of B.N.S. and Section 103(1) of BNS was added. of the Indian Penal Code which was earlier rejected vide order dated 10.02.2025 with an observation that the petitioner may be at liberty to renew his prayer for bail after six months, if so advised.
3. In this case, stage of trial was called for from the learned trial court. Learned trial court has reported that out of seven charge sheeted witnesses, five witnesses have been examined. Since, the trial is at advance stage and only two formal witness i.e., Doctor and I.O. are yet to be examined, I
Patna High Court CR. MISC. No.70155 of 2025(4) dt.28-11-2025 2/2 am not inclined to grant bail to the petitioner at this stage, as such, his prayer for bail stands rejected.
4. However, if he makes out a case that during trial, there is no evidence against him, he can file supplementary affidavit thereof.
5. Meanwhile, the trial court is directed to conclude the trial within three months.
6. The petitioner will be at liberty to renew his prayer for bail after three months.
