The petitioner is languishing in custody in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise Act.

There is recovery of 306 litres of illicit liquor. It is submitted by learned counsel for the petitioner that nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the recovery of seized illicit liquor. The recovery has been made in the open space. The petitioner is languishing in custody since

Patna High Court CR. MISC. No.71275 of 2022(2) dt.13-01-2023 2/2 19.08.2022. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.

In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Jhanjharpur, Madhubani in connection with G.R. No. 726 of 2022, arising out of Phulparas P.S. Case No. 401 of 2022.
