JUSTICE SHIVAJI PANDEY ORAL ORDER 09-12-2020 Heard Mr. Awadhesh Kumar Singh, learned counsel for the petitioner and Mr. Ajay Mishra, represening the State as also Ms. Archana Palkar Khopde, learned counsel for the Vigilance.

In this case, the petitioner is apprehending her arrest in connection with Ekma P.S. Case No. 148 of 2019 registered for offences under sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.

At the instance of the order passed by this Court in P.I.L. bearing CWJC No. 15459 of 2014, the First Information Report has been lodged with respect to the persons who have obtained their appointment in the Education Department as a Teacher on the basis of fake and fabricated documents.

Patna High Court CR. MISC. No.80083 of 2019(4) dt.09-12-2020 2/2 Learned counsel for the petitioner submits that the petitioner is no longer in service as she has tendered her resignation.

In that view of the matter, when the petitioner has already tendered her resignation, she is no longer in service and, thus, will be no purpose to put the petitioner behind bar. Looking to the entire facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Saran at Chapra in connection with Ekma P.S. Case No. 148 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, she will remain present and if she would not present herself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
