JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-09-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the state.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Bakhtiyarpur P.S. Case No. 110 of 2017 for the offences punishable under sections 448, 341, 323, 354, 307, 504 and 379/34of the I.P.C and section 27 of the Arms Act.

Allegedly, when the informant was sleeping at his Dalan the petitioners and other co-accused came there and started misbehaving with her and on the alarm being raised the husband of the informant came for rescue then he was assaulted by the petitioners and other co-accused by lathi, danda and butt of the

Patna High Court Cr.Misc. No.44239 of 2017 (2) dt.22-09-2017 2/2 pistol.

Submission is of false implication and that the present case has been instituted as a counter blast as one of the accused persons of the present case having instituted a case against husband of the informant earlier on 11.02.2017, the injuries received by the informant and her husband are simple in nature and the petitioners have got only one case in which they are on bail and as such the petitioners deserve sympathetic consideration. The learned A.P.P. submits that in this case other coaccused have been allowed pre-arrest bail vide Cr. Misc. No. 32662 of 2017.

In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M, Barh, Patna in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
