1. Heard the parties.
2. The petitioners apprehend their arrest in connection with Darbhanga Sadar P.S. Case No. 166 / 2023 dated 05.03.2023 registered under Sections 341, 324, 308, 385 / 34 of the I.P.C.
3. As per the first information report the informant-Md. Shamse Alam has alleged that on 05.03.2023 at about 22:10 Hours, while he was going out from his house the petitioners along with 4-5 persons having weapons in their hand arrived and petitioners assaulted the informant with dagger on his back side causing serious injury.

Learned counsel for the petitioners submits that both the parties are co-villagers and the informant was an accused along with the petitioner no. 1 in a case in which this court granted anticipatory bail to the petitioner no. 1 and the informant vide Cr. Misc. No. 10203 of 2021 (Annexure- P/1). Referring to the injury report, learned counsel submits that injury sustained by the informant is simple in nature caused by hard and blunt substance whereas the allegation against the petitioners, who are son and father respectively is that they assaulted with knife, which is a sharp cutting weapon.
5. Regard being had to the submission made by the parties, taking into consideration the fact that both the parties are co-villagers and injury sustained by the victim / informant is simple in nature, I am inclined to grant anticipatory bail to the petitioners.
6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of J.M. 1st Class Ms. Rani Choudhary at Darbhanga in connection with Darbhanga Sadar P.S. Case No. 166 / 2023 subject to the
