Petitioner has earlier moved this Court for grant of bail in Cr. Misc.No. 61551 of 2018, which was rejected vide order dated 19.11.2018 with direction to the trial Court to conclude the trial of the case within 9 months. Vide order dated 27.11.2019, the Court had called for the report from the trial Court regarding the stage of trial, which has been received and is kept at Flag-R. Perusal of the report shows that despite issuing non-bailable warrant witnesses have not turned up and the trial is not progressing.

Learned counsel appearing for the petitioner

Patna High Court CR. MISC. No.68388 of 2019(4) dt.04-03-2020 2/2 submits that despite direction of this Court, trial of the case has not been concluded as yet. Petitioner is in custody since 26.06.2018.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties as also the report of trial Court, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, IV, Gaya in connection with Sessions Trial No. 142 of 2018/569 of 2018 arising out of Atri P.S. Case No. 193 of 2016.
