The petitioner is seeking regular bail in Bhabua P.S. Case No. 188/2017 registered under Sections 25(1-b)a, 26, 35 of the Arms Act.

Learned counsel for the petitioner submits that in connection with Bhabua P.S. Case No. 184/17 U/S 392 IPC while conducting investigation police arrested one Wazid Ali Ansari, he made a confessional statement. It is stated that on the basis of the said confessional statement certain recoveries of arms and ammunitions were effected from the house of one Guddu Mian. The petitioner has been made accused in view of the confessional statement of Wazid Ali Ansari in Bhabua P.S. Case No. 184/17 as

Patna High Court Cr.Misc. No.44533 of 2017 (2) dt.20-09-2017 2/2 well as in the present case no recovery has been made from his possession and save and except the one case, as stated above, in which he is already on bail there is no other case against the petitioner.

Learned A.P.P. representing the State opposed the prayer for bail.

Considering the facts and circumstances, particularly that there is no recovery from the petitioner, let the petitioner, namely, Divesh Singh, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in Bhabua P.S. Case No. 188/2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
