JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 Petitioner seeks bail in anticipation of their arrest in connection with Wazirganj P.S. Case No. 279 of 2015, registered for the offences punishable under Sections 147, 149, 498A, 494 of the Indian Penal Code.

Petitioners are happens to to Nandoshi and Nanad of the informant. Case is under Section 498A of the I.P.C.. As per counsel for the petitioners they have already granted anticipatory bail by the learned Court below in the year 2015 but inadvertently they have not appeared before the Court below. Husband of the informant and other accused have already been granted anticipatory bail in this case. They are ready to abide by any condition imposed upon them.

Having heard both sides, considering the above facts as discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioners, however, the petitioners are directed to surrender before the learned Court below and make prayer for regular bail which shall be considered on the basis of material available on record and considering the fact that earlier petitioners have been granted anticipatory bail and due to inadvertence they have not appeared in the Court and further husband of the informant and other co-accused have already been granted anticipatory bail, and they are ready to abide by any condition imposed on them, considering the same bail prayer of petitioners shall be disposed of possible on the same day.
