2. Learned counsel for the petitioner submits that the present Cr. Misc. application has been filed for restoration of Cr. Misc. No. 42284 of 2025 to its original file which was dismissed for default on 23.07.2025 due to non-compliance of the peremptory order dated 09.07.2025 within the stipulated time. Counsel submits that vide order dated 09.07.2025, a direction was given by this Court for issuance of notice upon O.P. no.2 under both process, but requisites etc. for issuance of notice was filed after the stipulated time. Counsel submits that it is an inadvertent mistake and assures that in future, such
Patna High Court CR. MISC. No.72241 of 2025(2) dt.10-10-2025 2/2 mistake shall not occur.
3. As such, office is directed to accept the requisites filed by the counsel for the petitioner in pursuance of the order dated 09.07.2025.
4. In this view of the matter and the grounds mentioned in the application, the present Cr. Misc. No.72241 of 2025 is hereby allowed and let, Cr. Misc. No.42284 of 2025 be restored to its original file, subject to payment of cost of Rs.1,000/- (Rupees One Thousand) in the account of Advocates' Association, Patna High Court.
