JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-10-2017 The appellant seeks regular bail in connection with Chandramandih P.S. Case No. 01 of 2017, registered for offences punishable under Sections 341, 323, 324, 325, 307, 504/34 of the Indian Penal Code and section 3(i)(x) of SC/ST Act. Allegation against the appellant that he along with other accused persons assaulted the injured Subhi Paswan and there is specific allegation of assault by sword against the petitioner. It has been submitted on behalf of the appellant that he has falsely been implicated in this case and no specific allegation has been made as to on which part he has assaulted the injured with sword. Further appellant has been in custody for last six months.

Heard learned Special P.P. also.

APP (SJ) No.2614 of 2017 (4) dt.10-10-2017 2/2 Having heard both sides, in view of the fact that there is direct allegation against the petitioner of assaulting the injured by means of sword and injury report is still kept reserved, at this stage, I am not inclined to release the appellant on bail, his prayer for regular bail is dismissed.

However, he may renew his prayer for bail after framing of charge and if any such application is filed, the special court after verifying the nature of injury caused to the injured and also considering other materials on record, shall pass an appropriate order, without being prejudiced by the order of this Court.
