The petitioner seeks bail in connection with Katihar Town P.S. Case No. 317 of 2020 registered for the offence punishable under Sections 326, 307 and 34 of the Indian Penal Code.
As per the affidavit, being filed today, sworn by the Sub-Divisional Police Officer, Katihar, the Investigating Officer has already been examined as well as cross-examined and the trial was fixed for arguments. Let hard copy of the affidavit be filed during course of the day.
In view of the said development, learned counsel for the petitioner submits that a direction for expeditious conclusion
Patna High Court CR. MISC. No.70721 of 2022(5) dt.17-05-2023 2/2 would suffice in the matter.
In view of the affidavit and considering the submissions, the Court is of the view that at this stage, the petitioner should not be released on bail.
The prayer for bail of the petitioner is accordingly rejected, however, with a direction to the trial court to proceed in the matter for expeditious conclusion, without any unnecessary delay or undue adjournments.
