The present application has been filed for modification of the order dated 09.01.2018 passed in Cr.Misc.No. 136 of 2018, by which the petitioner was granted anticipatory bail in connection with Muffasil P.S. case No.169 of 2017 pending in the court of Additional Session sJudge VII-cum-Special Judge (Excise), Aurangabad and the petitioner was directed to surrender in the court below within a period of six weeks and furnish bail bond.
It is submitted on behalf of the counsel for the petitioner that due to inadvertence in the address column of the order dated 09.10.2018 passed in Cr.Misc.No.136 of 2018, the father's
Patna High Court Cr.Misc. No.6810 of 2018(2) dt.09-03-2018 2/2 name of petitioner has been typed as 'Jabir Ansari' in place of 'Jahur Ansari'.
Let in the order dated 09.01.2018 passed in Cr.Misc.No.136 of 2018, the father's name of petitioner be read as 'Jahur Ansari' in place of 'Jabir Ansari'. It is further prayed on behalf of the counsel for the petitioner that further time may be extended so that the petitioner could surrender in the court below and furnish bail bond.
Considering the submissions made on behalf of the learned counsel for the petitioner, the period of surrender of the petitioner in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order well be same.
The order dated 09.01.2018 passed in Cr.Misc.No. 136 of 2018, is modified to the extent as indicated above. The modification application is, accordingly, allowed. (Sudhir Singh, J) Narendra/- U T
