2. The petitioner has prayed for bail in connection with Rajoun P.S. Case No.04 of 2025 registered for the offence punishable under Section 303(2) of B.N.S.
3. The case of the prosecution is that the informant has parked his bike before his door. When he woke up at 11:00 P.M. he found that his bike was missing.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. F.I.R. was lodged against unknown miscreants. During course of investigation, one Mithilesh was apprehended and he
Patna High Court CR. MISC. No.69373 of 2025(2) dt.25-09-2025 2/2 has given his confessional statement. In the confessional statement of Mithilesh Kumar, name of this petitioner has surfaced. It has also been submitted that stolen bike was recovered from the possession of Mithilesh Kumar. Nothing has been recovered from the possession of the petitioner. He is languishing in judicial custody since 26.05.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail and has submitted that petitioner is having criminal antecedent of six cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka connection with Rajoun P.S. Case No.04 of 2025.
