JUSTICE SANJAY PRIYA ORAL ORDER 12-04-2018 Heard learned counsel for the petitioners and the State.
The petitioners apprehend their arrest in Ara Nawada P.S. Case No. 272 of 2017 instituted for the offence under Sections 406, 409, 420, 120(B) and 34 of the Indian Penal Code. The informant of the instant case was working as Branch Manager in Dobha Branch for Vishwamitra India Parivar
Patna High Court Cr.Misc. No.15194 of 2018 (2) dt.12-04-2018 2/3 whose office was situated near Judge Kothi, Ara. The main office of the company was at Vardhaman. It is alleged that money of the investors was invested in the aforesaid company by the complainant who has joined the office on 12.03.2012 on the assurance that money of investors was secured. It is alleged that complainant has invested total sum of Rs.4,11,459/- of public in Vishwamitra Social and Educational Trust, and receipt was given by the cashier. The sum of Rs.30,000/- on 05.03.2012 and also in other Schemes were deposited in Vishwamitra India Multi Development Limited. The money has also been invested by the Investors. But none of the depositors/investors were paid the assured amount as the accused persons fled away. It is further alleged that a Cheque of Rs.4,00,000/- was given by the C.M.D. of the Company on 10.09.2016 to the complainant when the aforesaid cheque was deposited in the bank, the same got bounced.
Learned counsel for the informant has appeared and submitted that all these petitioners were office bearer of the aforesaid Company. They have committed fraud and cheating with the depositors and fled away.
It is mentioned in paragraph 23 of the bail petition that petitioners are General Manager, Regional Manager, Area
Patna High Court Cr.Misc. No.15194 of 2018 (2) dt.12-04-2018 3/3 Managers, Chief Zonal Manager, Zonal Manager, and Zonal Head of the Company.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioners.
Prayer for anticipatory bail of the petitioners stands rejected.
