The petitioner apprehends his arrest in Deepnagar P.S. Case No.160 of 2017 registered under Section 379 of the Indian Penal Code and Section 4/40 of Bihar Minor Minerals Concession Rule, 1972 and Section 8(d) of Bihar Minerals ( Prevention of Illegal Mining, Transportation and Storage) Rule, 2003. The petitioner is alleged to be the driver of tractor on which the sand was loaded.
The learned counsel for the petitioner submits that the petitioner is simply a driver. The tractor was hired by a person who loaded the sand there.
Considering the facts aforesaid and the nature of allegation
Patna High Court Cr.Misc. No.8622 of 2018 (2) dt.17-02-2018 2/2 made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif in connection with Deepnagar P.S. Case No.160 of 2017 subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Sanjeev/- U T
