2. Petitioner seeks regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. There is recovery of 135 litres illicit liquor from the bags loaded on two motorcycles and one co-accused was apprehended on the spot. Petitioner is alleged to have fled away from the spot.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to political rivalry. Petitioner is owner of one of the motorcycles which was taken by co-accused Govind Kumar for some purpose, who was apprehended on the spot. Petitioner was not arrested on the spot. Nothing has been recovered from

Patna High Court CR. MISC. No.69244 of 2025(2) dt.24-09-2025 2/2 conscious possession of the petitioner. Petitioner has no concern with the seized liquor. There is no independent witness of the seizure list. Petitioner is in jail since 22.07.2025 having no criminal antecedent and he undertakes to cooperate in the trial.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case, the submissions of the parties and period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sitamarhi in connection with Sursand P.S. Case No.479 of 2023.
