JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-10-2017 The petitioner seeks regular bail in connection with Singheswar P.S. Case No. 107 of 2015 registered for offences punishable under Section 392 of Indian Penal Code. Allegation against the petitioner is that of theft of motorcycle and he is named in the F.I.R.
It has been submitted on behalf of the petitioner that informant has identified the petitioner in the light of the vehicle and he is in custody since long and trial has not been started. Heard learned APP also.
Having heard both sides, considering the fact and circumstances of the case, I am not inclined to release the petitioner on bail. However, learned C.J.M., Madhepura is directed to conclude the trial of the petitioner within a period of nine months and if the trial is not concluded, the petitioner is at liberty to renew his prayer for bail. With the above observation, this application is dismissed.
