JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-10-2017 The petitioner seeks regular bail in connection with Excise. Case No. 288 of 2016, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 840 litres of illicit country made liquor.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case only on the basis of suspicion and nothing has been recovered from his conscious possession and he has been in judicial custody since 10.08.2017. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, quantity of recovery and also the fact

No.45705 of 2017 (3) dt.10-10-2017 that petitioner is accused in two more cases of similar nature, as such, I am not inclined to release the petitioner on bail rather this application is disposed of with the direction to the court below to expedite the trial and try to conclude it within a period of four months and if the trial is not concluded within the aforesaid period, the trial court shall release the petitioner on bail to his own satisfaction.
