JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-06-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State assisted by learned counsel for the informant through video conferencing. Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased who allegedly with the help of his other family members killed the victim on account of non fulfilment of illegal demand within seven years of her marriage. The dead body of the deceased was also disposed of by the petitioner and others without giving any information regarding death of deceased to her parental people. Learned counsel of the petitioner submits that as a matter of fact, deceased died of her ailment as on the day of her

No.64663 of 2019(6) dt.03-06-2020 2/2 death, she started vomiting and thereafter, she was taken to local doctor but unfortunately, she could not be saved and thereafter, information regarding her death was given to informant and others and they participated in cremation of dead body of the deceased but subsequently, dispute arose between the parties on the point of return of ornaments as a result whereof, informant lodged this false case.

Considering the facts and circumstances of the case as well as this aspect of the matter that charge against the petitioner has already been framed, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Sessions Trial No. 649 of 2019 arising out of Bhador P.S. Case No. 61 of 2018 pending in the court of learned Additional Sessions Judge 2nd Barh, Patna stands rejected.

However, petitioner may renew his prayer for bail after seven months, if his trial is not concluded within the above stated period of seven months.
