2. The petitioner apprehends his arrest in connection with Mohania P.S. Case No. 184 of 2024 registered for the offences punishable under Sections 414 of the Indian Penal Code and under Sections 8, 20(B) & II B of the NDPS Act.

3. As per the prosecution case, 7.222 Kg of ganja has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has not committed any offence. He further submits that the recovery of the ganja is from one Dinesh Singh who has been granted regular bail by this Court vide order dated 26.10.2024 passed in Cr. Misc. No. 59535 of 2024. Petitioner is the driver of the vehicle.

5. Learned APP for the State has vehemently opposed the prayer for bail.

6. Considering the fact that recovery is from one Dinesh Singh and not from the petitioner, this application for anticipatory bail is allowed.

7. Accordingly, let the petitioner, above-named, in the event of his arrest or surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua/concerned court below in connection with Mohania P.S. Case No.184 of 2024 subject to the conditions as laid down under Section 438 of the Code of Criminal Procedure.

8. This application for anticipatory bail stands allowed.
