The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 135 of the Indian Electricity Act, 2003.

It has been alleged that petitioner was found committing theft of electricity. Assessment has been made of Rs. 1,37,883/-. Petitioner is ready to deposit 20% of the assessed amount.

In such view of the matter, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Shankar Prasad, be released on anticipatory bail on

Patna High Court Cr.Misc. No.45965 of 2017 (2) dt.10-10-2017 furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Electricity), Magadh Area, Gaya in connection with Barachatti (Mohanpur) P.S. Case No.342 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This Court directs the petitioner to deposit 20% of the amount which comes to Rs.27,438/-. In failure to deposit the said amount the bail so granted will be treated to have been cancelled.
