2. In the present case, the petitioner seeks bail in connection with Sabour P.S. Case No. 299 of 2023, registered for the offences under Sections 406, 419, 420 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and his co-accused mother on false pretext requested to give them an amount of Rs.25,000/-. As the informant was not having this amount with her at the persistent request of the petitioner and his co-accused mother, the informant gave them the ATM card of her mother-in-law. Subsequently, the fact came to the notice that petitioner and co-accused withdrew an amount of Rs.6,46,220.40/- by using the ATM/debit card.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.69557 of 2025(2) dt.08-10-2025 2/3 petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is a boy aged about 21 years and he is an acquaintance of the informant and her family. It was the informant who used the petitioner for withdrawing the money from the account of her mother-in-law and the petitioner did not receive a single farthing. An audio recording of talk between the petitioner and the informant was submitted before the Superintendent of Police and from the said audio recording it is evident that the informant used the petitioner and wrongfully withdrew the money lying in the account of her mother-in-law. After investigation police made the informant accused in this case. The petitioner has no knowledge about the fraud being committed by the informant and he only helped the informant due to his immaturity and being in good relationship with the informant. The petitioner is in custody singe 11.07.2025. Charge sheet has been submitted. The petitioner has no criminal antecedent.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the doubtful nature of allegation against the petitioner and also

No.69557 of 2025(2) dt.08-10-2025 3/3 considering submission of charge sheet and period of custody, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur/concerned court, in connection with Sabour P.S. Case No. 299 of 2023, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
