The petitioner apprehends his arrest in Wazirganj P.S. Case No.309/2017, registered under Sections 467, 468, 420 of the Indian Penal Code and Section 7 of the E.C. Act. The Sub-divisional officer, Sadar, Gaya inspected the licensee shop of the petitioner and found different irregularities enumerated in the written report.

Learned counsel for the petitioner submits that the petitioner did not commit any irregularity. Even from perusal of the item-6, it would appear that all the customers of Ramkishun Bigha stated that they got food grains for each month. It is submitted that some papers work were found irregular but there is nothing on the record to show that the petitioner sold the food

Considering the aforesaid fact and the nature of allegation made against the petitioner, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Gaya, in connection with Wazirganj P.S. Case No.309/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
