JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-02-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek pre-arrest bail in connection with Phulwaria P. S. Case No. 116 of 2017 registered under Sections 147, 148, 149, 153-A, 353-A, 295-A, 332, 327, 337, 307 and 427 of the Indian Penal Code and 27 of the Arms Act. It is contended by the learned counsel for the petitioners that similarly circumstanced co-accused Sonu Kumar Rai, Mantun Rai @ Nagendra Rai and Sumit Rai @
Patna High Court Cr.Misc. No.9321 of 2018 (2) dt.17-02-2018 2/2 Sumit Kumar have already been granted pre-arrest bail by a Bench of this Court vide order dated 23.01.2018 passed in Cr. Misc. No. 3077 of 2018 and Pappu Kumar Sah @ Pappu has also been granted pre-arrest bail vide order dated 01.02.2018 passed in Cr. Misc. No. 3951 of 2018.
The submissions made by the learned counsel for the petitioners have not been controverted by the learned Additional Public Prosecutor for the State.
Considering the facts and circumstances of the case and the submission made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in Phulwaria P.
