2. The petitioners apprehend their arrest in connection with Korma P.S. Case No.63 of 2024 registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.
3. Allegedly, while the brother of the informant and his cousin were strolling, in the meanwhile, the petitioners surrounded them and started abusing. On protest being made, the petitioner no.2 fired upon them; however, the pistol did not work. Later on, the petitioner no.2 assaulted the brother of the
Patna High Court CR. MISC. No.76443 of 2024(4) dt.19-05-2025 2/3 informant by means of butt. There is allegation against the petitioners no.1 and 3 that they also assaulted the brother of the informant by means of iron rod due to which he sustained severe injury.

Learned counsel for the petitioners submitted that, in fact, on account of previous enmity, both the parties have entered into a scuffle leading to institution of the counter case being Complaint Case No.194C of 2023 instituted by the mother of the petitioner no.1. It is further contended that the injuries which have been sustained to the informant and his cousin have been found to be simple in nature. It is also contended that on account of inadvertence with regard to the petitioner no.2, it has wrongly been averred that he has no criminal antecedent whereas he is carrying two criminal antecedent, which fact has been brought on record by way of supplementary affidavit. So far the petitioners no.1 and 3 are concerned, they are having fair antecedent.
5. On the other hand, learned counsel for the State opposed the bail application and submitted that the petitioners have actively participated in the crime.
6. Regard being had to the submissions made on behalf of the parties and considering the factum of case and

No.76443 of 2024(4) dt.19-05-2025 3/3 counter case, coupled with the simple nature of injury, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate 1st Class, Sheikhpura in connection with Korma P.S. Case No.63 of 2024, subject to the condition as laid down under Section 482(2) of the BNSS, with further condition that one of the bailors shall be the own/close family members of the petitioners.7.
7. So far the petitioner no.2 is concerned, he will deposit a cost of Rs.5000/- with the Patna High Court Legal Services Committee before furnishing his bail bond(s). (Harish Kumar, J) rohit/- U T
