The petitioner, who is in custody, seeks bail in connection with Kahalgaon P.S. Case No. 147 of 2017 registered for the offence punishable under Sections 341, 323, 307, 384, 379/34 of the Indian Penal Code.

The allegation against the petitioner is that he taken away 1 H.P. Motor, Pipe and wire which fitted in the well amounting to Rs. 15,000/- .

Learned counsel for the petitioner submits that he is innocent and has committed no offence. It has further been submitted that he has falsely been implicated in this case due to land dispute and he is in custody since 08.06.2017.

No.45000 of 2017 (2) dt.21-09-2017 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon P.S. Case No. 147 of 2017.
