JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-11-2017 Heard learned counsel for the petitioner and the counsel appearing on behalf of the University. Counsel for University submits with reference to Annexure-8 dated 9.11.2017 that the University has already issued notification, withdrawing order of transfer and as such he submits that writ petition for all practical purposes has become infructuous.
Mr. Abhinav Srivastava appearing on behalf of the petitioner submits that it is true that Annexure-8 to a great extent redresses the grievance of the petitioner, but he is more concern with his reputation as the kind of stigma attached has tarnished the image of this petitioner who is at the verge of superannuation. He
Patna High Court CWJC No.13116 of 2017 (3) dt.30-11-2017 2/2 submits that he proposes to represent the University and as such he submits that Vice-Chancellor of the University and his representation may be directed to consider the representation to be filed by the petitioner on the point of stigma. If the representation is filed within a period of one month from today, the Vice Chancellor will look into the representation independently not being influenced by any other materials and pass a reasoned speaking order within a further period of three months from the receipt of the representation. With the aforesaid, the writ petition stands disposed of.
