2. The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition& Excise Amendment Act.

3. The case of the prosecution is that altogether 135 liters of Nepali liquor was recovered from three plastic bags.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from conscious possession of the petitioner. It has been submitted that from perusal of the seizure list, it will transpire that the witnesses are police personnel and the seizure list does not contain the signature of the petitioner. The petitioner is in custody since 18.08.2025

Patna High Court CR. MISC. No.70124 of 2025(2) dt.07-10-2025 2/2 having one criminal antecedent in which he is on bail.

5. The learned APP for the State vehemently opposes the prayer for bail of the petitioner.

6. Considering the fact and circumstances of the case and submissions of the parties, let the above named petitioner, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Madhubani in connection with Benipatti Excise P.S. Case No. 128 of 2025.
