The petitioner, who is in custody, seeks bail in connection with Pakaridayal P.S. Case No. 16 of 2017 registered for the offence punishable under Sections 387 and 120 B of the Indian Penal Code.
Informant has alleged in FIR that he received phone call from one Shiv Shankar Sharma for ransom of Rs. 30 lakhs otherwise to face consequences.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR, his name has transpired during the course of investigation. There is no incriminating material against the petitioner and he has been falsely implicated in this
Patna High Court Cr.Misc. No.45060 of 2017 (2) dt.21-09-2017 case only on suspicion. Nothing has been recovered from his possession and he has no concern with said Shiv Shankar Sharma. It has further been stated that co-accused Mritunjay Thakur and Subodh Kumar Singh have been granted bail by this Hon'ble Court passed in Cr. Misc. No. 34965 of 2017 dated 04.08.2017 and Cr. Misc. No. 39663 of 2017 dated 21.08.2017 respectively. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Pakaridayal P.S. Case No. 16 of 2017.
