JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 This is an application for grant of anticipatory bail in connection with Sugauli P. S. Case No. 221 of 2019, disclosing offences under Sections 341, 353, 504, 34 of IPC and Sections 33, 41, 42 of Indian Forest Act, 1927 and Section 1, 3, 5, 8, 9, 11, 13, 14 of Bihar Saw Mills (Regulation) Act, 1990. As per F.I.R. petitioner and other accused persons were illegally running the saw mill, when the Forest Officials raided the saw mill, they had attacked the forest officials. Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against any of the petitioners and there is general and omnibus allegation

Patna High Court CR. MISC. No.70132 of 2019(2) dt.15-11-2019 2/2 against them. They are ready to abide by any conditions imposed upon them. Considering the same, other accused persons have been granted privilege of anticipatory bail by this Court, vide order dated 17.09.2019 passed in Criminal Misc. No. 58652 f 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of lerned C.J.M. East Champaran, at Motihari, in connection with Sugauli P. S. Case No. 221 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
