2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 323 , 324, 325 , 307, 504 and 34 of the Indian Penal Code.

3. As per F.I.R. , petitioner No. 1 Lucky @ Aman Raza have caused grievous injury to the informant and so far as petitioner No. 2 Ayan @ Ayan Raza and petitioner No. 3 Safi Alam are concerned, injury caused by them is found to be simple in nature .

4. Considering the nature of injury and gravity of

Patna High Court CR. MISC. No.73019 of 2023(3) dt.29-02-2024 2/2 offence , prayer for pre-arrest bail of the petitioner No. 1 is rejected. So far as petitioner Nos. 2 and 3 are concerned, since injury caused by them are simple in nature, their prayer for anticipatory bail is allowed.

5 . Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner Nos. 2 and 3 , as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Gopalganj in connection with Thawe P.S. Case No. 171 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
