2. The petitioner seeks bail in connection with Karwandia P.S. Case No. 84/2025, registered for the offence under Sections 143(1), 144(1), 144(2), 64(1), 111, 61(2), 3(5)
2/5 of the Bharatiya Nyaya Sanhita and Sections 3/4/5/6/7 of the Immoral Traffic (Prevention) Act, and Section 18 of Child Labour (Protection) Act, Section 75/79 of the Juvenile Justice Act and Sections 4, 8 of the POCSO Act.
3. The accused/petitioner is named in the F.I.R. and is in custody since 06.08.2025.
4. As per FIR, petitioner has been found to be involved in trafficking of women for the purpose of prostitution.
5. Learned counsel appearing on behalf of the petitioner submitted that recovered girls are major and they are daughters of co-accused Dasrath Nut. It is also pointed out that they nothing stated incriminating against petitioner, who is relative of the victim. It is also submitted that similarly situated co-accused, namely, Hema Devi has already granted bail by a co-ordinate Bench of this Court through Cr. Misc. No. 68030 of 2025 dated 07.10.2025. While concluding the argument, it is submitted that investigation of this case is already completed, for which chargesheet has been submitted, as such, there is no chance of tampering with the evidence. Petitioner is a lady of clean antecedent.
6. Learned APP opposed the prayer of bail.
7. Considering the aforesaid factual submissions and by
3/5 taking note of fact as apprehended victims stated nothing incriminating against this petitioner, suggesting her involvement with crime in question, coupled with the fact that investigation is already completed, where petitioner being lady of clean antecedent, remains in custody since 06.08.2025, accordingly, petitioner above named, is directed to be released on bail in connection with Karwandia P.S. Case No. 84/2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge, Vith cum Special Judge, POCSO, Sasaram, District- Rohtas/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
