2. The petitioners seek regular bail in connection with Bhawanipur P.S. Case No. 77 of 2023 registered for the offence under Sections 147, 149, 341, 323, 324, 325, 307, 504, 506 of the Indian Penal Code.
3. As per prosecution case, the FIR named accused persons including the petitioners by forming an unlawful assembly having deadly weapons assaulted the informant and his family members due to which they sustained injuries. The petitioner no.1 has specifically been alleged to give iron rod blow on head of Raban Kumar and petitioner no.2 gave iron

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. They have falsely been implicated in this case due to family land dispute. There is case and counter case, both parties have sustained injuries as alleged in separate occurrences. The petitioners have got no criminal antecedent as stated in para-3 of the bail petition and they are languishing in judicial custody since 24.8.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Bhawanipur P.S. Case No. 77 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dhamdaha, Purnia.
