Mr.Veena Kumari Jaiswal ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-10-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Gaurichak P.S. Case no. 266 of 2019, registered under Section 302 and 201/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that on 18.06.2019 at 6.00 P.M., father of informant Baban Kumar had gone to market for correction in Aadhar Card, but he did not return. On the next morning, informant came to know that the dead body of his father Saroj Yadav was found in the ditch, then he along with

Patna High Court CR. MISC. No.64358 of 2019(2) dt.24-10-2019 2/2 other family members went there and saw his father lying dead sustaining firearm injuries. On seeing the dead body, it appeared that his father was killed other place and his dead body was thrown there. The informant raised suspicion regarding hand of petitioners in the murder of his father due to previous dispute.

Learned counsel for the petitioners submits that it would appear from the F.I.R. that name of the petitioners has been disclosed by the informant having hand in the murder of his father mere on suspicion due to grudge and earlier dispute. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of thier arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-I, Patnacity in connection with Gaurichak P.S. Case No. 266 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
