For the Petitioner/s : Mr. Mukesh Kumar Jha For the Opposite Party/s : Mr. Sir Pramod Kumar Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2017 Heard the parties.
This application is for grant of regular bail in connection with S.T.No.1 of 2017 arising out of Falka P.S.Case No.202 of 2016 for the offences punishable under Sections 302/34 of the Indian Penal Code.
Allegation against the petitioner is of causing death of his wife as he had illicit relation with one another lady. Submission of the learned counsel for the petitioner is that two witnesses have been examined in this case and son of the deceased has not supported the prosecution case. The petitioner is in custody for more than one year. Heard learned A.P.P. also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.45931 of 2017 (3) dt.17-10-2017 Having heard both sides and in view of fact that the allegation is of causing death of his wife and only two witnesses have been examined, as such I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if possible, conduct it on day-to-day basis. At the same time, the S.P., Katihar is directed to ensure presence of all the witnesses so that the trial may be concluded within the period as specified.
With the aforesaid observation, this application is disposed of.
