JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2018 Petitioner apprehends her arrest in connection with Shambhuganj P.S.Case No. 80 of 2016 registered under Sections 147, 148, 149, 341, 323, 307, 353, 380, 427, 435, 504, 506, 120B of the Indian Penal Code and 3 & 4 of Damage of Public Property Act.

Allegation as per FIR is that a mob on the death of son of petitioner turned violent and damaged official records and set the vehicle on fire.

Submission of learned counsel for the petitioner is that the petitioner is mother of Dhirendra Kr. Singh, who died and it cannot be said that she would indulge in such crime. Further submission is that other co-accused have been granted privilege of anticipatory bail by different Benches of this Court.

Having heard both sides and in view of facts and circumstances and considering the fact that other co-accused have been granted privilege of anticipatory bail, let the petitioner, above named, in the event of her arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Shambhuganj P.S.Case No. 80 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in investigation and appear before the Investigating Officer as and when required, except on genuine ground, failing which her bail bond shall be cancelled.
