2. The petitioner has prayed for bail in connection with Madhubani Town P.S. Case No. 225 of 2024 registered for the offence punishable under Sections 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act which was earlier rejected by this Court vide order dated 24.01.2025 passed in Cr. Misc. No. 64589 of 2024 with an observation that the petitioner is at liberty to renew his prayer for bail after six months.
3. The case of the prosecution is that while the informant was cooking food at her house, she heard the sound of
Patna High Court CR. MISC. No.70354 of 2025(2) dt.26-09-2025 2/3 firing when she came out from her house, she found that her husband has received gun shot injury and was in a pool of blood. She took her husband to the hospital with the help of the neighbourers where her husband was declared dead. It has further been alleged by the informant that her husband was working in Maharani Honda Agency from last ten years as an Accountant. Her husband has told her two-three days prior to the occurrence that one of his colleagues Raj Kamal Thakur has defalcated Rs. 1 lakh and eighty thousand regarding which he had knowledge and told him to disclose it to the owner. He has promised to give share in that defalcated money but when the husband of the informant denied, Raj Kamal Thakur has threatened him of dire consequences. Informant believes that her husband was killed by Raj Kamal Thakur by hatching a conspiracy.
4. Learned counsel for the petitioner has submitted that the name of this petitioner has surfaced in the confessional statement of this petitioner. It has also been argued by the learned counsel for the petitioner that till today only five witnesses have been examined and the case is far from being concluded as so many witnesses are still left to be examined by the learned trial court. No.70354 of 2025(2) dt.26-09-2025 3/3 petition of co-accused namely, Rajan Kumar Jha whose bail was also rejected along with this petitioner earlier by this Court, has been granted bail by this Court vide order dated 29.08.2025 passed in Cr. Misc. No. 60309 of 2025. Moreover the petitioner is languishing in judicial custody since 01.06.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Madhubani in connection with Madhubani Town P.S. Case No. 225 of 2024.
